The Aircraft Act
Convention of the International Recognition of Rights in Aircraft Act No. 59 of 1993 (the Aircraft Act) and its regulations came into operation early in 1998 and represents yet another movement of the SA Government towards international standards. The Aircraft Act requires, that all deeds of mortgage over aircraft be registered with the Civil Aviation Authority (CAA), and among other things that all mortgages which include Special Notarial Mortgage Bonds be registered in the register held at the CAA. A copy of the duplicate original of the mortgage bond will be lodged with the CAA at time of registration.
Any contravention or failure to comply with provisions or any regulation of the Aircraft Act may result in a penalty of a fine and/or imprisonment not exceeding ten years.
